Overview

As part of the Multimedia Super Corridor initiative launched in 1996, the Malaysian government committed to creating a world-class legal and regulatory environment for the digital economy. This commitment was fulfilled through the passage of five landmark pieces of cyber legislation between 1997 and 1998 — collectively known as Malaysia's Cyber Laws.

These laws were significant not only for Malaysia but for the broader Asian region, establishing Malaysia as one of the first developing nations to create a comprehensive legal framework for electronic commerce, digital communications, and cybersecurity.

The cyber laws remain in force today and continue to underpin Malaysia's digital economy regulatory environment, administered by the Malaysian Communications and Multimedia Commission (MCMC) and relevant government ministries.

MSC Malaysia Bill of Guarantees

As part of its commitment to attracting global technology investment, MSC Malaysia issued a Bill of Guarantees that included a pledge not to censor the Internet. This guarantee is enshrined in both the Communications and Multimedia Act 1998 and the MSC Malaysia policy framework, making it a foundational principle of Malaysia's digital economy approach.

Communications and Multimedia Act 1998 (CMA)

The primary regulatory framework governing communications and multimedia activities in Malaysia. The CMA establishes the Malaysian Communications and Multimedia Commission (MCMC) and sets out the licensing framework, consumer protection provisions, and content standards for Malaysia's convergent communications industry.

Extended Malaysia's copyright protection framework to cover digital content and online works. This amendment was essential to supporting Malaysia's creative multimedia industry under the MSC Malaysia initiative and ensured that intellectual property rights applied in the digital environment.

The Communications and Multimedia Act 1998

The most frequently referenced of Malaysia's cyber laws, the Communications and Multimedia Act 1998 (CMA) represents the cornerstone of Malaysia's digital regulatory framework. It replaced the older Telecommunications Act 1950 and Broadcasting Act 1988 with a convergence-friendly regulatory regime suited to the digital age.

Key provisions of the CMA include the establishment of the MCMC as the industry regulator, the licensing framework for network facilities providers, network service providers, applications service providers and content applications service providers, and importantly, the content standards and prohibitions under Sections 211 and 233.

Section 233 of the CMA — which prohibits the improper use of network facilities or network services — has been the subject of significant judicial and public debate in Malaysia, and is among the most cited provisions in the country's digital rights discourse.
